By accessing or using PolyBot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. PolyBot is operated by Apex Technology Enterprises (Pty) Ltd ("the Operator").

1. Risk Disclaimer

PolyBot is experimental automated trading software provided "as is" without any warranty. Trading on prediction markets involves substantial risk of loss. Past performance is not indicative of future results. You may lose some or all of your deposited funds. PolyBot and its operators accept no responsibility for financial losses incurred through use of this platform. This is not financial advice. By using PolyBot, you acknowledge that you are solely responsible for your trading decisions and any resulting gains or losses.

2. No Financial Advice

PolyBot does not provide financial, investment, legal, or tax advice. The strategies, signals, and automated actions provided by the Service are algorithmic in nature and do not constitute recommendations to buy, sell, or hold any position. You should consult a qualified financial advisor before making any trading decisions.

3. No Guarantees

The Operator makes no guarantees regarding the profitability, performance, or accuracy of any trading strategy offered through the Service. Historical backtest results and past trading performance do not guarantee future results. Market conditions change, and strategies that performed well historically may result in losses.

4. User Responsibilities

As a user of PolyBot, you are responsible for:

Maintaining the security of your wallet credentials, private keys, and account passwords. The Operator is not liable for losses resulting from compromised credentials.
Ensuring that your use of prediction markets complies with all applicable laws and regulations in your jurisdiction. Prediction markets may be restricted or prohibited in certain regions.
Confirming that you are at least 18 years of age (or the age of legal majority in your jurisdiction).
Understanding the risks of automated trading and setting appropriate bet sizes and limits.
Monitoring your account activity and stopping the bot if you observe unexpected behaviour.

5. Platform "As Is"

The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Operator does not warrant that the Service will be uninterrupted, error-free, or free of bugs, viruses, or other harmful components.

6. Management Fees

The Operator may charge management fees for use of the Service. Fees are deducted automatically from your trading account or balance as described during sign-up or in your account settings. All fees are non-refundable once deducted. The Operator reserves the right to modify fee structures with reasonable notice to users.

7. Service Availability

The Service may be modified, suspended, or discontinued at any time, with or without notice. The Operator is not liable for any modification, suspension, or discontinuation of the Service. Scheduled and unscheduled maintenance may result in temporary unavailability.

8. Data Handling

Your account credentials and wallet connection details are encrypted using AES-256 encryption and stored on secure servers. The Operator will never share your personal data or credentials with third parties. Data is retained only for as long as necessary to provide the Service. You may request deletion of your account and associated data by contacting the Operator.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or funds, whether incurred directly or indirectly, arising from your use of or inability to use the Service. This includes, without limitation, losses arising from: trading decisions made by the automated system, technical failures, API outages from third-party services (including Polymarket, Polygon, or price data providers), network congestion, or wallet interaction errors.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
